What can be sold

Makerbay is for goods made or designed by the person selling them. On top of that rule, some goods cannot be listed. Some wait for checks we have not built yet. Others are never allowed, because the law, our payment processor or the shipping carriers rule them out. This list changes as categories open.

Not yet

These can open later. Requests decide the order, through the category request form.

Food and drink, including pet treats and chews

Most states' home kitchen laws only allow sales inside the maker's own state. Shipping across state lines usually means a licensed or inspected kitchen, and some foods, like shelf-stable sauces, need a tested recipe and federal filings first. Pet chews count as treats. That includes antler, bone, horn and hoof chews, bully sticks and other items made to be gnawed.

Supplements, herbal remedies and tinctures

A product that claims to treat or prevent a disease is a drug under federal law, and supplements have their own manufacturing and labeling rules. These open once listings can screen health claims.

Toys and anything made for children 12 and under

That includes baby clothes and kids' jewelry. Children's products need lead limits, testing or a small-batch registration, and tracking labels under federal law, and several states add their own lead limits.

Some knives

Fixed blades and manual folding knives are allowed, for buyers 18 and over. Assisted-opening knives, daggers and dirks wait until listings can block shipping to the states that restrict them. Swords and machetes wait for approval from our payment processor. Hatchets and axes made as tools follow the knife rules. Tomahawks and throwing axes wait with swords. Slingshots wait until listings can block shipping to the states that ban their sale.

Perfume, nail polish and other flammable or hazardous goods

That includes cologne, nail polish and remover, spray paint and sprayed fixatives, matches, lighters, some resin kits, and the etching creams, fluxes and patina chemicals used on glass and metal. They ship under hazardous materials rules: ground only, special labels and size limits, and some carriers will not take them to Alaska or Hawaii.

Cosmetics that make drug claims

Sunscreen and SPF products, acne and eczema treatments, antibacterial soap and hand sanitizer are drugs under federal law. Bath and body on Makerbay is for non-drug products: soap, lotion, balm, bath salts and the like.

Topical CBD

Waiting on approval from our payment processor. Goods made from hemp fiber or hemp seed oil are allowed now.

Pet products with pest or health claims

Collars, beds and sprays that claim to repel fleas, ticks or other pests need federal and state pesticide clearance. Products that claim to calm, heal or treat a pet count as animal drugs under federal law. Pet supplies without these claims are allowed.

Some paper and garden goods

Seed paper and plantable cards wait with live plants and seeds. Bird seed, suet and seed wreaths wait with food and pet treats. Paper made to hold or serve food, like cupcake liners, food wraps and treat boxes, waits because several states restrict the coatings used on food packaging. Garden goods sold to repel or kill pests, like mosquito, deer or mole repellers, count as pesticides or pest control devices under federal law. Planters ship empty, without soil or live moss.

Goods with coin or button batteries

That includes sound and light-up cards, light-up jewelry and decor, and small solar lights. Federal law requires tested battery covers and warning labels on these, and they wait until listings can check them.

Filled bedding in some states

Several states require makers of pillows, cushions, quilts, comforters, padded seats and pet beds to register before selling there. These items ship only to states where the seller is registered or exempt. Pillow covers without an insert, and blankets and throws without batting, ship to every state. Mattresses, mattress pads, toppers and futons wait for federal flammability checks.

Live plants and seeds

Federal plant quarantines restrict what can move out of certain counties, and those areas change by notice. These open once listings can check them.

Under review

These are not allowed at launch while we review them: tobacco pipes, memorial jewelry made with cremated remains, hair art, replica and inert ordnance, prop and replica guns, self-defense tools including kubotans and striking key chains, cast bars and coin-like rounds of gold, silver or platinum, and 3D-printable files for firearm accessories.
